HB 2612

Association Records

Overview

HB 2612 adds a new category of condominium and planned community records that an association need not provide in response to a member’s request for records, specifically, any records the member requested within the preceding two years that have not been changed.

Key Changes

  • Amending A.R.S. 33-1258 and A.R.S. 33-1805 by adding that a community association may withhold records requested by a member if the member requested the same records within the preceding two years and such records have not been modified.

Legislative Timeline

  • January 21, 2026 – House Second Reading
  • January 20, 2026 – Introduced; House First Reading; Assigned to House Government and Rules Committee

Impact

HB 2612, if enacted, could alleviate administrative burdens on boards of directors and managers by reducing repetitive records requests, as they can now decline to provide records that have already been supplied and remain unchanged within the last two years.
